This essay demonstrates, and critiques, the pervasiveness of economic assumptions in the jurisprudence of privacy in US constitutional law as it extends from birth control and abortion rights to the so-called right to die. Finding in these cases metaphors of neoliberal productive practices and the assumption of the self as human capital, the self understood as a site of investment rather than a repository of worth, the essay brings privacy law into conversation with Kristin Luker's empirical work on abortion politics (...) and teenage pregnancy. The essay does not treat the right to die as a moral or political problem to be resolved, but is instead interested in the revelatory character of the jurisprudence of privacy — namely, in what it can tell us about the contemporary political economic order. The Supreme Court’s reversal of the right to abortion has significantly changed reproductive rights in the United States, and adversely affected the lives of potentially pregnant persons. The political fragility of the privacy right to abortion also raises questions about the practice and epistemic rules of American constitutionalism itself. In this essay, I situate the history of privacy under the Fourteenth Amendment’s due process clause in the tradition of legal reasoning. With Ludwig Wittgenstein’s On Certainty, I argue that the majority (...) in Dobbs v. Jackson (2022) departs from this tradition. The upshot of this departure is that we now have a new interpretive language game battling a long established language game of interpretation–battling, that is, a constitutional tradition–in a contest to redefine how disagreement is transacted among justices and between the people and their government. Jane Arden’s debut feature film The Other Side of the Underneath is an adaptation of the radical feminist play A New Communion for Freaks, Prophets and Witches. In both the play and the later film, the all-female cast re-enact personal and archetypal situations using autobiographical material, which was collectively gathered from group therapy sessions led by the director. Psychedelic drugs were also consumed during the group therapy sessions. In this article, I will situate Arden’s distinct approach to performance in (...) the film within the framework of psychodrama, focusing specifically on the role that psychedelic drugs play in unleashing performers’ repressed feelings of trauma, rage, and desire; these emotions are harnessed into a dynamic mode of performance that amplifies the cathartic possibilities of women’s speech. The film’s heady brew of radical feminist politics, group therapy, and countercultural self-actualisation is both challenging and contentious. I argue that Arden’s pursuit of consciousness liberation through psychodrama and psychedelics—in other words, through ‘raising’ and ‘expanding’ consciousness—is best understood as a concerted attempt to align countercultural and radical feminist tactics for unravelling repressive forms of social conditioning. Cilj je studije bio utvrditi učiteljsku procjenu znanja o simptomima, etiologiji i tretmanu ADHD-a te njenu povezanost sa sociodemografskim obilježjima učitelja, obilježjima škole i učiteljevoj samoprocjeni općeg znanja o ADHD-u. Prigodan uzorak činilo je 233 učitelja. Primijenjen je Upitnik učiteljskih znanja o ADHD-u trofaktorske strukture: Simptomi, Etiologija i Tretman ADHD-a, odgovarajuće pouzdanosti. Učitelji poznaju važnost tretmana za akademske i socijalne ishode učenika s ADHD-om te simptome ADHD-a, dok iskazuju nedovoljno poznavanje etiologije ADHD-a. Prisutne su zablude u identificiranju uzroka ADHD-a u (...) obiteljskim stresnim okolnostima. Učiteljska procjena općeg znanja o ADHD-u povezana je s višom razinom znanja o simptomima i tretmanu, radnim mjestom učitelja razredne nastave, dok je viša razina znanja o tretmanu povezana s nižom kronološkom dobi učitelja. Implikacije dobivenih nalaza ukazuju na značaj stjecanja kompetencija učitelja za poučavanje učenika s ADHD-om tijekom inicijalnog obrazovanja i trajnog profesionalnog razvoja, kao i osiguravanja podrške stručnjaka edukacijskih rehabilitatora. The aim of this study was to determine the teachers’ level of their perceived knowledge about ADHD and the connection between the teachers’ perceived knowledge and their sociodemographic characteristics, characteristics of the school they are affiliated with and their self-assessment of their general knowledge about ADHD. The sample was convenient and included 233 teachers. We used the Questionnaire of Teachers’ Knowledge of ADHD with three factored structure: Symptoms, Etiology of ADHD and Treatment of ADHD, with the adequate internal consistency. Teachers are aware of the importance of the treatment for the academic and social outcomes of students with ADHD. They also recognize the symptoms of ADHD. Their knowledge of the etiology of ADHD is insufficient. There are misconceptions related to identifying the cause of ADHD in family stressful circumstances. The teachers’ assessment of their general knowledge of ADHD is connected to higher level of knowledge about the symptoms and treatment, and position of primary school teacher. Higher level of knowledge about the treatment is connected to lower age of the teachers. Implications of these findings point out to the importance of obtaining the relevant competences during the initial study of the teachers as well as during their further professional development. The importance of professional support provided by educational rehabilitators is also highlighted. (shrink)

In _Vibrant Matter_ the political theorist Jane Bennett, renowned for her work on nature, ethics, and affect, shifts her focus from the human experience of things to things themselves. Bennett argues that political theory needs to do a better job of recognizing the active participation of nonhuman forces in events. Toward that end, she theorizes a “vital materiality” that runs through and across bodies, both human and nonhuman. Bennett explores how political analyses of public events might change were we (...) to acknowledge that agency always emerges as the_ _effect of ad hoc configurations of human and nonhuman forces. She suggests that recognizing that agency is distributed this way, and is not solely the province of humans, might spur the cultivation of a more responsible, ecologically sound politics: a politics less devoted to blaming and condemning individuals than to discerning the web of forces affecting situations and events. Bennett examines the political and theoretical implications of vital materialism through extended discussions of commonplace things and physical phenomena including stem cells, fish oils, electricity, metal, and trash. She reflects on the vital power of material formations such as landfills, which generate lively streams of chemicals, and omega-3 fatty acids, which can transform brain chemistry and mood. Along the way, she engages with the concepts and claims of Spinoza, Nietzsche, Thoreau, Darwin, Adorno, and Deleuze, disclosing a long history of thinking about vibrant matter in Western philosophy, including attempts by Kant, Bergson, and the embryologist Hans Driesch to name the “vital force” inherent in material forms. Bennett concludes by sketching the contours of a “green materialist” ecophilosophy. (shrink)

When discussing the problem of evil, philosophers often distinguish between physical evil (harm caused within the natural world such as natural disasters, disease, and the like), and moral evil (harm caused by human agency). Mapping this traditional distinction is mapped onto the third section of Fichte’s The Vocation of Man would at first seem fairly straightforward: for Fichte, evil arising from nature occurs through “blind mechanism” and is unfree; in contrast, evil done by human beings arises out of free agency. (...) The answer may be more complicated, however, in two different ways. First, Fichte holds that nature is to be cultivated and controlled by human beings so that it is no longer a source of harm; this may imply that the continuing harm done by nature is the result of humans’ failure to have sufficiently tamed nature. In that case, some of the harm caused by nature may be attributable to free human causality and thus no longer be a clearcut instance of natural evil. Second, Fichte repeatedly states that those who fail to act morally and who fail to conform their wills to the moral law are still be in the power of the mechanisms of nature. Even though we must think of them as free, Fichte compares their actions to the operation of nature and its mechanism of necessity. By presenting a careful and nuanced Fichtean account of the traditional distinction between physical and moral evil, we can better appreciate how Fichte understood the meaning and scope of human responsibility. Aristotle's account of female nature has received mostly negative treatment, emphasising what he says females cannot do. Building on recent research, this book comprehensively revises such readings, setting out the complex and positive role played by the female in Aristotle's thought with a particular focus on the longest surviving treatise on reproduction in the ancient corpus, the Generation of Animals. It provides new interpretations of the nature of Aristotle's sexism, his theory of male and female interaction in generation, and his (...) account of inherited features. It also discusses a range of more general issues which can and should be re-examined in light of Aristotle's account of female animals: his methodology, hylomorphism, teleology and psychology. In _influx & efflux_ Jane Bennett pursues a question that was bracketed in her book _Vibrant Matter_: how to think about human agency in a world teeming with powerful nonhuman influences? “Influx _& _efflux”—a phrase borrowed from Whitman's "Song of Myself"—refers to everyday movements whereby outside influences enter bodies, infuse and confuse their organization, and then exit, themselves having been transformed into something new. How to describe the human efforts involved in that process? What kinds of “I” and “we” (...) can live well and act effectively in a world of so many other lively materialities? Drawing upon Whitman, Thoreau, Caillois, Whitehead, and other poetic writers, Bennett links a nonanthropocentric model of self to a radically egalitarian pluralism and also to a syntax and style of writing appropriate to the entangled world in which we live. Clicks, comments, transactions, and physical movements are being increasingly recorded and analyzed by Big Data processors who use this information to trace the sentiment and activities of markets and voters. While the benefits of Big Data have received considerable attention, it is the potential social costs of practices associated with Big Data that are of interest to us in this paper. Prior research has investigated the impact of Big Data on individual privacy rights, however, there is also growing recognition of (...) its capacity to be mobilized for surveillance purposes. Our paper delineates the underlying issues of privacy and surveillance and presents them as in tension with one another. We postulate that efforts at controlling Big Data may create a trade-off of risks rather than an overall improvement in data protection. We explore this idea in relation to the principles of the European Union’s General Data Protection Regulation as it arguably embodies the new ‘gold standard’ of cyber-laws. We posit that safeguards advocated by the law, anonymization and pseudonymization, while representing effective counter measures to privacy concerns, also incentivize the use, collection, and trade of behavioral and other forms of de-identified data. We consider the legal status of these ownerless forms of data, arguing that data protection techniques such as anonymization and pseudonymization raise significant concerns over the ownership of behavioral data and its potential use in the large-scale modification of activities and choices made both on and offline. Effective corporate social responsibility policies are a requirement for today's companies. Policies have not only to be formulated, they also have to be delivered by corporate employees. This paper uses existing research findings to identify two types of factors that may impact on employee motivation and commitment to CSR ‘buy-in’. The first of these is contextual: employee attitudes and behaviours will be affected by organizational culture and climate, by whether CSR policies are couched in terms of compliance or in terms (...) of values, and by whether such policies are integrated into business processes or simply an ‘add-on’ that serves as window-dressing. The second set of factors is perceptual. Motivation and commitment will be affected by the extent to which they can align personal identity and image with that of the organization, by their perceptions of justice and fairness both in general and in terms of how CSR performance is rewarded, and by their impressions concerning the attitude of top management to CSR issues and performance. I argue that T.M. Scanlon's contractualist account of morality has difficulty accommodating our intuitions about the moral relevance of the number of people affected by an action. I first consider the "Complaint Model" of reasonable rejection, which restricts the grounds for an individual's rejection of a principle to its effects upon herself. I argue that it can accommodate our intuitions about numbers only if we assume that, whenever we do not know who will be affected, each individual may appeal only (...) to the _expected effects on her. This assumption, I suggest, leads to counterintuitive results in cases where, although we do not know who will be affected, we do know that _someone will be. I then consider two proposals to supplement the complaint model with a direct appeal to aggregation. I argue that both are open to serious objections. (shrink)

This Element provides an account of Aristotle on women which combines what is found in his scientific biology with his practical philosophy. Scholars have often debated how these two fields are related. The current study shows that according to Aristotelian biology, women are set up for intelligence and tend to be milder-tempered than men. Thus, women are not curtailed either intellectually or morally by their biology. The biological basis for the rule of men over women is women's lack of spiritedness. (...) Aristotle's Politics must be read with its audience in mind; there is a need to convince men of the importance of avoiding insurrection both in the city and the household. This essay seeks to give philosophical expression to the vitality, willfullness, and recalcitrance possessed by nonhuman entities and forces. It also considers the ethico-political import of an enhanced awareness of "thing-power." Drawing from Lucretius, Spinoza, Gilles Deleuze, Bruno Latour, and others, it describes a materialism of lively matter, to be placed in conversation with the historical materialism of Marx and the body materialism of feminist and cultural studies. Thing-power materialism is a speculative onto-story, an admittedly presumptuous attempt to depict the (...) nonhumanity that flows around and through humans. This paper aims to establish that, for Aristotle, the state of the physical body is crucial to the human capacity for theoretical understanding. In recent years, scholars have begun to recognise the importance of Aristotle’s biological writings for understanding his psychology, after the relative neglect of these connections. The relevance in particular of the so-called Parva naturalia, small works on what is common to body and soul, and the De motu animalium, a work devoted to animal motion in broad terms, (...) has begun to fill in the picture of how the living body is involved in cognition. This paper will support this point of view by adding the De generatione animalium, a work which gives an account of the advent of soul capacities through the development of the body from the blood, under the control of the nutritive soul. An Aristotelian science of human physiology is a study of the “thinking body”, a person as a whole rather than disembodied nous. I will first set out factors that have made it difficult to integrate Aristotle’s biological treatises into our understanding of human thinking. Next, I will distinguish the thinking shared with other animals, from theoretical understanding, which is something only humans can achieve. I will then explain the aspects of the body that must facilitate and eventually bring about the capacity for thinking, before turning to Aristotle’s embryology where nutritive soul is ultimately responsible for the construction and maintenance of the thinking body. It will be concluded that only a human body leads to theoretical understanding and only a healthy human body can do so adequately. (shrink)

EVER SINCE BALME’S GROUNDBREAKING WORK on the subject, there has been substantial progress in our understanding of the importance of biology in Aristotle’s philosophy. Despite a certain reluctance to incorporate treatises on animals into the undergraduate curriculum, it is now inadvisable to avoid any reference to Aristotle’s biological work when discussing most aspects of his thought. The new tendency of scholarship on Aristotle’s biology employs various methodologies but, in the main, argues for the importance of Aristotle’s biological treatises on the (...) basis of the assistance they might provide for understanding some of the more intractable problems in Aristotle’s thought. A longstanding problem in the teacher workforce, internationally and in the UK, is the continuing and substantial numbers of qualified teachers who leave the profession within five years. This paper uses data collected from a survey to the last five years of teacher education graduates of UCL Institute of Education (IOE) in London, to explore what originally motivated them to teach, and the reasons why they have left or may consider leaving in the future. We discovered that despite claiming to (...) be aware of the challenges of workload before entering teaching, workload was the most frequently cited reason for having left, or for leaving in the future. The data spoke to the reality of teaching being worse than expected, and the nature (rather than the quantity) of the workload, linked to notions of performativity and accountability, being a crucial factor. This paper draws on a substantial new source of data and explores reasons for leaving in the context of reported initial motivation of individuals who have left teaching, individuals who are planning to leave and individuals who are planning to stay in teaching. It is a piece of common sense that we can be mean-spirited, cruel, and unfair in the ways that we form beliefs. That is, we can wrong others through our doxastic activity. This fact shows that, contrary to an increasingly widespread view in the ethics of belief literature, morality has a role to play in guiding doxastic deliberation, and evidence is therefore not the only ‘right kind of reason’ for belief. But the mere existence of doxastic wronging does not tell (...) us anything about how, exactly, morality enters into doxastic deliberation. These two lessons are crucial for getting debates in the ethics of belief back on the right track. (shrink)

The ‘psychologist’s green thumb’ refers to the argument that an experimenter needs an indeterminate set of skills to successfully replicate an effect. This argument is sometimes invoked by psychological researchers to explain away failures of independent replication attempts of their work. In this paper, I assess the psychologist’s green thumb as a candidate explanation for individual replication failure and argue that it is potentially costly for psychology as a field. I also present other, more likely reasons for these replication failures. (...) I conclude that appealing to a psychologist’s green thumb is not a convincing explanation for replication failure. This paper presents a novel position in the philosophy of logic: I argue that _validity_ is a thick concept. Hence, I propose to consider _validity_ in analogy to other thick concepts, such as _honesty_, _selfishness_ or _justice_. This proposal is motivated by the debate on the normativity of logic: while logic textbooks seem simply descriptive in their presentation of logical truths, many have argued that logic has consequences for how we ought to reason, for what we ought to believe, or (...) for what we ought to infer. How can logic be normative, if it appears to be descriptive? According to the proposal of this paper, the normativity of logic can be explained because a thick concept is in play: _validity_. Thus, I argue that the debate on how to best characterize validity and the debate on logic’s normativity are more connected than we think, because _validity_ is a thick concept. (shrink)

Philosophers and psychologists have often maintained that in order to attribute mental states to other people one must have a ‘theory of mind’. This theory facilitates our grasp of other people’s mental states. Debate has then focussed on the form this theory should take. Recently a new approach has been suggested, which I call the ‘Direct Perception approach to social cognition’. This approach maintains that we can directly perceive other people’s mental states. It opposes traditional views on two counts: by (...) claiming that mental states are observable and by claiming that we can attribute them to others without the need for a theory of mind. This paper argues that there are two readings of the direct perception claims: a strong and a weak one. The Theory-theory is compatible with the weak version but not the strong one. The paper argues that the strong version of direct perception is untenable, drawing on evidence from the mirror neuron literature and arguments from the philosophy of science and perception to support this claim. It suggests that one traditional ‘theory of mind’ view, the ‘Theory-theory’ view, is compatible with the claim that mental states are observable, and concludes that direct perception views do not offer a viable alternative to theory of mind approaches to social cognition.
